The illegal export of Indonesia’s natural resources is a continuing problem that needs greater attention and supervision of activities in order to reduce the level of illegal exports. To this end the Minister of Trade has issued Regulation No. 14/M-DAG/PER/5/2008 with the view of increasing supervision of certain exported mine products. A list of the mineral resources that are going to be subject to this increased supervision is listed in Attachment I.
Simply, all exports of the listed mineral resources are to be subject to verification or technical survey before export can be categorized as being legal. The verification is designed to ensure that the mineral resources destined for export have satisfied all the applicable administrative and technical requirements for that product. The verification process will also confirm the amount or volume of product being exported against the applicable tariff list through lab analysis.
The results of the verification are to form the basis of a Surveyor’s Report that is to be included in the Export Goods Notification (Pemberitahuan Ekspor Barang / PEB) form or the Customs Notification Single Administrative Document (Pemberitahuan Pabean Single Administrative Document / PPSAD).
The surveys and verification processes may only be undertaken by approved surveyors. Approved surveyors are to be confirmed by the Minister once the surveyor has submitted all the requisite documents for approval. However, once approved by the Minister, any failure on the surveyor’s part to complete their duties as required pursuant to prevailing laws and regulations would permit the Minister to revoke any recognition previously granted.
The Regulation was confirmed on 5 May 2008 but does not come into force for a further 2 months from that date.
